Burglary Penalties
First Degree Burglary: punishable by 2, 4

“Strike” under California’s “Three Strikes and You’re Out” Law. What
this means is that if you commit any other felony (including some minor
drug offenses and felony petty theft) in the future, your sentence on
the new case is doubled.
Second Degree Burglary: punishable in county
jail or state prison depending on how it is filed. Second Degree
Burglary is a wobbler, meaning that it can be charged as either a
misdemeanor or a felony in California. If it is a misdemeanor then the
maximum sentence is a year in county jail. If filed as a felony then the
maximum sentence is 3 years in state prison. However, Second Degree
Burglary is not a “Strike” under California law.

Robbery is theft through the use of force or fear. If someone
attempts to take something by brandishing a firearm or threatening the
victim with physical violence, you could be charged with robbery.
"Robbery" and "Burglary" are two terms that are often confused or
used interchangeably. There is a big difference between these two
charges. The main difference between a robbery and burglary is that in a
burglary, the victim is not present. In a robbery the victim is present,
and the taking has to be from the victim by way of force, fear or
intimidation. Weapons could also be involved in a robbery, which will
elevate the charges even further.
